1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the Dawson Watches website, products, and related services.

The website is operated by Dawson LLC, doing business as Dawson Watches (“Dawson Watches,” “we,” “us,” or “our”).

By accessing our website or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the website.

You must be at least the age of majority in your state or country of residence. Alternatively, you may use the website with the involvement and consent of a parent or legal guardian.

3. Product Information and Availability

We aim to describe and display our products accurately. However, colors and appearance may vary depending on your screen, lighting, production batch, or the manufacturer.

Measurements, weights, colors, and other specifications may be approximate. Product packaging and minor details may change without notice where the product remains materially equivalent.

Products, prices, promotions, and availability may change without notice. We may limit quantities, withdraw products, or correct errors.

Displaying a product on our website does not guarantee that the product is available or that we are legally required to accept an order for it.

4. Orders

Your order is an offer to purchase products from us.

We may accept, reject, limit, or cancel an order for legitimate reasons, including:

Inventory or availability errors
Incorrect prices or product information
Payment problems
Suspected fraud or unauthorized activity
Shipping restrictions
Suspected commercial resale
Legal or regulatory requirements

An automated order-confirmation email acknowledges that we received your order but does not necessarily mean that we accepted it.

We accept your order when we dispatch the product or otherwise expressly confirm acceptance.

If we cancel an order after receiving payment, we will refund the canceled amount to the original payment method.

You agree to provide current, complete, and accurate billing, delivery, contact, and account information.

5. Prices, Payments, and Taxes

Prices on the US website are displayed in US dollars unless stated otherwise.

Applicable sales taxes and shipping charges will be calculated or displayed at checkout.

International customers are responsible for customs duties, import taxes, brokerage fees, and similar destination-country charges unless the checkout expressly states otherwise.

Available payment methods are displayed at checkout. Payment services may be governed by additional terms and eligibility requirements imposed by the relevant payment provider.

6. Shipping and Delivery

Our Shipping Policy forms part of these Terms.

Processing and delivery times are estimates unless we expressly state otherwise. Delivery may be affected by carriers, weather, customs, holidays, address issues, and circumstances outside our reasonable control.

If we cannot ship within the promised timeframe, we will notify you and provide the option to accept the delay or cancel the unshipped order for a full refund, as required by applicable law.

7. Returns and Refunds

Our Return and Refund Policy forms part of these Terms.

Eligible returns must be requested within 30 days of delivery and must meet the conditions stated in that policy.

Nothing in our Return and Refund Policy limits any consumer right or remedy that cannot legally be limited.

8. Limited Warranty

Eligible watches are covered by our One-Year Limited Warranty, subject to its terms, conditions, exclusions, and applicable law.

The complete warranty must be made available to customers before purchase.

9. Promotions and Discount Codes

Promotions and discount codes are subject to their stated conditions, availability, and expiration dates.

Unless expressly permitted, promotions and discount codes cannot be:

Combined with other offers
Redeemed for cash
Applied after a purchase
Transferred or resold
Used for commercial resale orders

We may cancel or correct a promotion affected by fraud, misuse, technical problems, or a material error.

10. Intellectual Property

The website and its content—including text, graphics, photographs, logos, icons, product curation, designs, and software—are owned by or licensed to Dawson LLC and are protected by intellectual-property laws.

Except where permitted by law, you may not copy, reproduce, distribute, modify, publicly display, sell, publish, or otherwise exploit website content without our prior written permission.

Third-party names, trademarks, product images, and logos belong to their respective owners. Their appearance on our website does not transfer any ownership rights to you.

11. Reviews and Submitted Content

If you submit a review, photograph, video, comment, suggestion, or other content, you represent that:

You have the right to submit it
It is accurate and lawful
It does not infringe another party’s rights
It does not contain malicious code or deceptive material

You retain ownership of your submitted content.

You grant Dawson LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, use, reproduce, adapt, publish, translate, and display that content for operating, improving, and promoting our business, subject to applicable privacy law.

We may moderate or remove submitted content, but we are not required to do so.

12. Third-Party Services

Our website may use or link to third-party services, including payment providers, digital wallets, installment-payment providers, carriers, social networks, and other websites.

We are not responsible for the independent content, availability, security, or practices of third-party services. Your use of a third-party service is governed by that provider’s terms and policies.

13. Disclaimers

Except for our One-Year Limited Warranty and to the fullest extent permitted by law, the website and services are provided “as is” and “as available.”

We do not guarantee that the website will always be uninterrupted, secure, accurate, or free from errors.

Nothing in these Terms excludes, limits, or disclaims any warranty, right, or remedy that cannot legally be excluded, limited, or disclaimed.

This section does not disclaim implied warranties applicable to products covered by our written Limited Warranty. Any permissible limitation of those implied warranties is stated in the Limited Warranty itself.

14. Limitation of Liability

To the fullest extent permitted by law, Dawson LLC and its officers, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profits, revenue, data, goodwill, or business opportunities arising from the website, services, or products.

To the fullest extent permitted by law:

Our total liability for a claim relating to a product will not exceed the amount paid for that product.
Our total liability for any other claim will not exceed US$100.

These limitations do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or certain personal injuries where applicable.

Some jurisdictions do not permit particular exclusions or limitations. In those jurisdictions, some of the provisions above may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dawson LLC and its officers, employees, agents, and affiliates from third-party claims, damages, and reasonable costs arising from:

Your unlawful misuse of the website
Your violation of these Terms
Content you submit
Your infringement of another party’s rights

This obligation does not apply to the extent that Dawson LLC caused the claim.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Applicable federal law governs federal matters.

Any court proceeding must be brought in a state or federal court located in Wyoming, and each party consents to the jurisdiction and venue of those courts.

This section does not prevent an eligible consumer from bringing a claim in small-claims court or exercising a right that cannot be waived under the laws of the consumer’s state of residence.

These Terms do not require arbitration.

17. Changes to These Terms

We may update these Terms by publishing a revised version with a new effective date.

Changes apply prospectively. Your continued use of the website after the revised Terms take effect constitutes acceptance where permitted by law.

18. General Provisions

If any provision of these Terms is held to be unenforceable, it will be enforced to the maximum extent permitted by law. The remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision.

You may not transfer or assign these Terms without our consent. We may assign them in connection with a financing, restructuring, merger, acquisition, or sale of business assets.

These Terms and the policies incorporated into them constitute the entire agreement concerning their subject matter.
